just like the wire

Off-Duty Officer Fatally Shot by Police

it's hard not to think of the roland prezbelewski character when you read about this. However, there are a couple major differences.

1. In the wire both characters are in plain clothes, although Prez's race is an obvious indicator of his "being a police."

2. The are pursuing a person after reports of a shooting. They have lost sight of that person.

In the NY incident above, the uniformed officer obviously shot before giving a warning. The officer in plain clothes, would most likely have been conscious of this fact and been more submissive to the uniformed cops.

Which leads me to wonder, what chances does a common citizen have when being confronted by police?
